1. PURPOSE

This Legal Advice regulates access to and browsing of the website located at the URL www.mr-red.com (hereinafter, "Mr. Red Website"), and through which we inform you about your rights and obligations in relation to the content displayed on it, the logos and trademarks used, as well as the responsibilities that may arise from its use. Accessing, browsing or using the Mr. Red Website implies the express and unreserved acceptance of all the terms of this Legal Advice, which has the same validity and effectiveness as any contract entered into in writing and signed.Notwithstanding the foregoing, the Club reserves the right to modify the presentation, configuration and content of the Mr. Red Website, as well as thisLegal Advice, so we recommend that you review it regularly. The Club offers information on the Mr. Red website related to the receipt of business proposals from third parties interested in collaborating, as well as information related to the submission of CVs or professional applications from people who wish to work with the Club. Such interactions will be carried out after the user has submitted the relevant information and in accordance with the applicable terms and conditions, as well as other general content. 

2. INTELLECTUAL AND INDUSTRIAL PROPERTY RIGHTS

The Club is the owner or, where applicable, has the corresponding licences for the intellectual and industrial property rights, image rights or any other similar rights relating to the Mr. Red website, as well as all the content offered on it, including, but not limited to, photographs, illustrations, logos, trademarks, graphics, designs, interfaces or any other information or content included on it. You only have a non-exclusive right of use, within a strictly domestic environment and solely for the purpose of browsing the Mr. Red website in accordance with thisLegal Advice. The un authorised use of the information on the Mr. Red website, its resale, as well as any infringement of the Club's intellectual or industrial property rights will give rise to the corresponding legal liabilities. All third-party links to the Mr. Red website must be to its home page, and any act of framing or deep linking, or any other use of the contents of the Mr. Red website, in favour of un authorised third parties is expressly prohibited.

3. RULES FOR USE OF THE MR. RED WEBSITE

It is not permitted, and therefore you will be solely responsible for the consequences, to access, browse or use the Mr. Red website for illegal or un authorised purposes, whether for financial gain or not. In particular, and without the following list being exhaustive, the following is prohibited: 
· Using Web Mr. Red in any way that may cause damage, interruptions, inefficiencies or defects in its operation orin third-party devices; 
· Using the Mr. Red website to transmit, install or publish any virus, Trojan horse, worm, logic bomb, malicious code or other harmful programmes or files; 
· Using the Mr. Red website to transmit material for advertising or promotional purposes, including spam, chain emails or similar; 
· Use Web Mr. Red in a manner that constitutes a violation of the rights of the Club or any third party; 
· Use Web Mr. Red to transmit or publish any material that is defamatory, offensive, racist, vulgar, derogatory, pornographic, or of an obscene or threatening nature, or that may annoy, harm or merely affect any person; 
· Using Web Mr. Red to collect personal data from other users; 
· Using Web Mr. Red illegally, contrary to good faith, morality and/or public order; 
· Accessing any section of Web Mr. Red, other systems or networks connected to it, any Club server or the services offered through Web Mr. Red without authorisation by means of hacking or falsification, password extraction or any other illegitimate means; 
· Carrying out any action that causes disproportionate or unnecessary saturation of the Mr. Red website infrastructure or the Club's systems or networks, as well as the systems and networks connected to the Mr. Red website itself. Failure to comply with any of the above obligations on your part may result in the Club taking appropriate measures under the law in the exercise of its rights or obligations.

4. RESPONSIBILITIES AND GUARANTEES

The Club cannot guarantee, nor does it guarantee, the reliability, usefulness or accuracy of all the information contained on the Mr. Red website, nor the usefulness or accuracy of the content made available to users through it. The Club is not responsible for the accuracy, completeness or degree of updating of information that it has not produced itself and for which another source is indicated, nor for information contained in other websites via hyperlinks or links from the Mr. Red website, which may be provided as alternative sources of information and which are governed by their own terms and conditions.  Consequently, the Club does not guarantee and is not responsible for: 
· The continuity of the contents of the Mr. Red website; 
· The absence of errors in said content; 
· The absence of viruses, Trojans, worms, logic bombs and/or other malicious or technologically harmful components on Web Mr. Red or on the server that supplies it; 
· The invulnerability of Mr. Red's website and/or the impossibility of breaching the security measures adopted therein; 
· The lack of usefulness or performance of the contents of Web Mr. Red; 
· Failures of Web Mr. Red caused by any type of attack on its servers or those of third-party service providers of theClub, as well as technical or security failures of the system of any of these providers that prevent the operation of Web Mr. Red; 
· Any technical failure of any kind that hinders, delays or prevents the proper functioning of Web Mr. Red; 
· Damages or losses caused to one self or to a third party by any person who violates the conditions, rules and instructions established by the Club on Web Mr. Red or through the violation of security systems. 

The Club declares that it has taken all necessary measures, within its capabilities and the state of the art, to ensure the functioning of Web Mr. Red and to minimise system errors, both from a technical point of view and in terms of the content published on Web Mr. Red. The Club shall not be liable for the accuracy, integrity or updating of the information published on the Mr. Red website from sources other than itself, nor for the information contained on other platforms linked to from the Mr. Red website. The Club reserves the right to suspend, modify, restrict or interrupt, either temporarily or permanently, access, navigation, use, hosting and/or downloading of content and/or use of Web Mr. Red services, with or without prior notification to users who contravene any of the provisions detailed in this Legal Advice, without the possibility of claiming compensation for this reason.

6. CONFIDENTIALITY AND DATA PROTECTION

In accordance with the provisions of Regulation (EU) 2016/679 of the EuropeanParliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free move ment of such data, and repealing Directive 85/46/EC (hereinafter, "GDPR")and Organic Law 3/2018, of 5 December, on the Protection of Personal Data andGuarantee of Digital Rights (hereinafter, "LOPDGDD"), all personal data provided during the use of the Mr. Red website will be processed in accordance with the provisions of the Mr. Red website Privacy Policy, which you must read and, where applicable, accept and/or consent to.

7. SAFEGUARD CLAUSE

All clauses or points of this Legal Advice shall be interpreted independently, and the rest of the clauses shall not be affected if one of them is declared null and void by a final court ruling or arbitration decision. The clause or clauses affected shall be replaced by another or others that preserve the effects pursued by this Legal Advice.

8. APPLICABLE LEGISLATION AND JURISDICTION

Current regulations shall determine the laws that shall govern and the jurisdiction that shall hear the relations between the Club and users. However, provided that such regulations provide for the possibility for the parties to submit toa specific jurisdiction, for any litigious matter arising from or related to this Website or the services offered therein, the Spanish legislation in force at the time of the dispute shall apply.  Likewise, in those cases in which said current regulations provide for the possibility for the parties to submit to a specific jurisdiction, the Club and users, expressly waiving any other jurisdiction that may apply, submit to the Court sand Tribunals of Madrid.
